Can neighbours prevent you from building an Attefallshus?

It's one of the most common questions from those planning to build an Attefallshus on their plot: what happens if the neighbor protests? The short answer is that neighbors cannot refuse an Attefallshus – but there are a couple of exceptions worth knowing.

Since December 2025, neither a building permit nor a notification is required

Attefallshus and other attefallsåtgärder have been regulated in the Planning and Building Act (PBL) since 2014. Until 1 December 2025, a notification to the municipality and a start decision were required before construction start – but not a building permit.

Since the rule change on 1 December 2025, neither a building permit nor a notification is required to erect an Attefallshus. This also means that the municipality no longer has a formal role in the process – and that neighbors' ability to influence via statements to the municipality has disappeared.

Neighbors cannot refuse an Attefallshus

Because neither a notification nor a building permit is required, there is no formal process in which neighbors can submit comments. A neighbor cannot refuse or stop an Attefallshus – the only influence is related to the house's placement on the plot, which concerns a distance requirement, not a general veto.

When can an Attefallshus actually be prevented?

There are situations where an Attefallshus can still be prevented or require further review.

The most common cases:

  • A detailed development plan or area regulations prohibit accessory buildings on the plot, or limit building height and placement.

  • The building is planned on land that is not designated as plot land – for example on agricultural land or natural land without a defined plot boundary.

  • The property is located within a shoreline protection area, an area of national interest (riksintresse) or another protected zone where special rules apply.

  • The house's placement conflicts with the technical requirements regarding distance to the property boundary – the main rule is 4.5 metres from the boundary, otherwise the neighbor's written consent is required.

In these cases it is not the neighbor's protest itself that stops the construction, but that the measure does not meet the legal requirements for attefallsåtgärder.

Distance to the property boundary – the practical exception

If you want to place the Attefallshus closer than 4.5 metres from the neighboring plot, written consent from the affected neighbor is required. If that is not possible, you must instead apply for a building permit. If the plot borders municipal land, since December 2025 you can apply directly to the municipality for permission for a closer placement.

What counts as written consent?

A verbal agreement is not sufficient. The consent must be in writing and signed by the affected property owners.

Protected areas require notification to the County Administrative Board

The freedom from notification and building permit does not apply everywhere. In certain protected areas the requirement for notification remains – but then it is the County Administrative Board, not the municipality, that handles the case. This applies, among others, to:

  • Shoreline-protected areas

  • Cultural heritage areas and listed buildings

  • Military protected areas

  • Properties covered by the municipality's design program or special area regulations

It is still possible, but expect a longer process and no guaranteed approval.

How do you avoid conflicts with neighbors?

Although a neighbor cannot legally stop a compliant Attefall house, a good relationship with the immediate neighbors is always worth maintaining. A few things that can help:

  • Inform neighbors in good time, preferably before you start construction. An early dialogue reduces the risk of misunderstandings.

  • Show sketches or drawings so the neighbor can concretely understand what is planned.

  • Consider placement and design in relation to existing houses – a well-placed building rarely provokes strong reactions.

  • If the house is placed close to the boundary, ask for written consent at an early stage.

A well-drawn ancillary building seldom provokes protests – and it's not only a matter of aesthetics. A thoughtful placement, correct ridge height, choice of materials that adapt to the surroundings and a facade expression that respects the character of the plot contribute to the building being perceived as a natural addition rather than an intrusion.
